General Work Agreement
These terms apply to every quote we send and every project we complete, unless your signed proposal says otherwise. Plain language, no surprises — that's the point.

1Who this is between
This agreement is between Brightest In The Room Inc. ("BITR", "we", "us") and the client named on the quote ("you"). It governs the painting and related work described in your written quote or proposal (the "Work").
2Your quote, and what changes it
Your quote is a fixed price for the scope, surfaces, and assumptions listed in it. It is valid for 30 days. Quantities taken from drawings or photos are confirmed at a pre-start walkthrough.
If something needs to change — added rooms or surfaces, a different finish, or a site condition worse than the stated assumptions (failing paint, water or smoke damage, plaster repair, extensive patching) — we price it in writing and you approve it before that part of the work begins. We never bill a surprise after the fact, and we never absorb a material change silently.
3Deposit and payment
Residential projects require a 25% deposit to secure your start date; the balance is due on completion after you have walked the finished work with us and you are satisfied. Commercial terms (net-30, purchase order, mobilization payment, statutory holdback where the Construction Act applies) are set out in your proposal.
We accept e-transfer, credit card, and cheque. Tinted paint ordered specifically for your project is non-refundable once mixed.
4Schedule and access
We confirm your start date once the deposit is received. You agree to provide reasonable access to the work areas, along with power and lighting. Delays caused by access, occupancy, or other trades on site may shift the schedule; we will always keep you informed.
5Materials, prep, and what's included
Unless your quote states otherwise, we use Benjamin Moore products, and our price includes standard surface preparation (clean, fill minor holes, light sand, spot-prime), protection of floors and fixtures, and daily tidy-up. Anything listed under "Exclusions" on your quote is not included and is quoted separately if you want it.
6Our 2-year workmanship warranty
We warrant our workmanship for two years from completion. If a painted surface we applied peels, blisters, or fails under normal conditions, we will make it right at no charge. The warranty does not cover damage from moisture intrusion, structural movement, abuse, or surfaces we advised against and noted in writing.
7Insurance and WSIB
BITR carries $4M commercial general liability insurance and maintains WSIB coverage in good standing. Certificates are available on request.
8Cancellation and your cooling-off rights
You may cancel a residential agreement signed in your home within the cooling-off period provided by the consumer-protection law of the province where the work is performed (10 days in Ontario and British Columbia). To cancel, contact us in writing. If you cancel outside that window, deposits may be applied to costs already incurred (including non-refundable tinted materials), with any balance credited toward a future project.
9Liability
We take care of your home or premises and carry insurance for the rare case something goes wrong. Our liability for any claim is limited to the value of the Work, except where the law does not allow such a limit. We are not responsible for pre-existing defects or for conditions we could not reasonably have known about.
10Questions, and governing law
This agreement is governed by the laws of the province where the Work is performed. If anything is ever unclear or unfair in your eyes, tell us — we would rather sort it out directly than leave you unhappy. Reach us at (437) 219-0876 or hello@brightestintheroom.com.
